Congress Seeks To Enforce White House Subpoenas

House Judiciary Committee Chairman John Conyers has stated he will seek to enforce the subpoenas issued last week in connection with the investigation into abuses in the Justice Department.  The White House has rejected these subpoenas claiming “executive privilege.”  Conyers has announced he will seek a Contempt of Congress citation, saying "The President's response to our subpoena shows an appalling disregard for the right of the people to know what is going on in their government.”  Such a citation would likely result in a court showdown similar to United States v. Nixon in which the supreme Court ruled unanimously that President Nixon’s refusal to respond to subpoenas citing “executive privilege” was illegal.

Bruce Fein, a former Justice Department official in the Regan Administration is calling on Congress to impeach Vice President Dick Cheney.  According to Fein:

 

Cheney has dulled political accountability and concocted theories for evading the law and Constitution that would have embarrassed King George III. The most recent invention we know of is the vice president's insistence that an executive order governing the handling of classified information in the executive branch does not reach his office because he also serves as president of the Senate. In other words, the vice president is a unique legislative-executive creature standing above and beyond the Constitution. The House judiciary committee should commence an impeachment inquiry. As Alexander Hamilton advised in the Federalist Papers, an impeachable offense is a political crime against the nation. Cheney's multiple crimes against the Constitution clearly qualify.

Court:  Bush’s Treatment Of “Enemy Combatant” Violates Constitution

In a blow to the Bush administration’s claim of vast powers in the “war on terror,” the Fourth U.S. Circuit Court of Appeals has ruled that the Bush administration cannot detain a legal U.S. resident indefinitely despite labeling him an “enemy combatant.”  The case involves Ali al-Marri, a legal U.S. resident, who was arrested at his home in Peoria, Illinois in December 2001 and has been detained since then, without charges, in solitary confinement at a Navy facility.  The Court stated that permitting the indefinite detention of civilians held without the right to contest their imprisonment would have “disastrous consequences for the constitution and the country.”  The Court also ruled that al-Marri must be released from military detention.

The House Republicans are moving to have Rep. William Jefferson, a Louisiana Democrat, expelled from the House of Representatives one day after he was indicted on bribery and money laundering charges. Under the GOP majority, Ohio Republican Bob Ney was permitted to remain in the House until after he was convicted of bribery and corruption charges related to super-lobbyist Jack Abramoff.

GOP House Leader John Boehner is spearheading the effort to force Jefferson out, but he was singing a different tune on Fox News last fall when it came to Ney:

WALLACE: On this same subject, this week Congressman Bob Ney, one of your Republican colleagues in the House, agreed to plead guilty to influence-peddling. Now, he has stepped down as chairman; he’s still a member of Congress.

This is a man who is basically admitting that he sold his vote. Should he spend another day in the House?

BOEHNER: Bob Ney clearly admitted to making some big mistakes. And he’s going to pay dearly for the mistakes that he’s admitted to.

But he’s also checked himself in for alcohol abuse. And right now my prayers are with him and his family. It’s a sad day for the Congress and a sad day for Bob Ney.

WALLACE: Should he resign from the House?

BOEHNER: That’s a decision that he and his family are going to have to make.
